- Reverse engineer, decompile, or attempt to extract the source code or models behind the Services.
- Use the Services to generate content that is unlawful, defamatory, hateful, infringing, sexually explicit involving minors, or otherwise harmful.
- Resell, sublicense, or commercially redistribute the Services without our written permission.
- Interfere with or disrupt the integrity or performance of the Services.
5. User Content & Generated Output
You retain ownership of the input content (images, text, brand materials) you submit to the Services. You grant Aarla Nextech a limited licence to process, store, and use this input solely to provide and improve the Services.
Subject to your compliance with these Terms and payment of applicable fees, Aarla Nextech assigns to you the rights to commercially use the AI-generated output produced specifically for you. You are responsible for ensuring that any input you submit does not infringe third-party rights.
6. Intellectual Property
The Services, including all software, models, designs, trademarks, logos, and the Aarla Nextech name, are the exclusive property of Aarla Nextech LLP or its licensors. No rights are granted to you other than as expressly stated in these Terms.
7. Subscription, Fees & Payment
Paid plans are billed in advance on a recurring basis according to the plan you select. All fees are non-refundable except where required by law. We may modify pricing with reasonable prior notice; changes will not apply to billing cycles already paid.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services you consent to those practices.
9. Disclaimers
The Services are provided on an "as is" and "as available" basis. AI-generated output may contain errors or unexpected results and should be reviewed before publication or commercial use. To the fullest extent permitted by law, Aarla Nextech disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, Aarla Nextech and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with the Services. Our aggregate liability for any claim shall not exceed the amount you paid to Aarla Nextech in the twelve months preceding the event giving rise to the claim.
11. Indemnity
You agree to indemnify and hold harmless Aarla Nextech, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Services, your input content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Services at any time.
13. Changes to the Terms
We may update these Terms from time to time. We will indicate the date of the most recent revision at the top of this page. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.
